Schedule a video consultation with attorney Erwin Kratz to discuss dividing retirement benefits in your divorce. Choose the consultation type that fits your situation.
Not sure which type is right for you? Here is a guide. If you still have questions after reading, call us at (520) 577-5155 and we can help you decide.
A focused 15-minute video consultation to answer your specific questions about dividing retirement benefits in your divorce. You submit your questions when you book, and the attorney will address them directly during the call.
A 30-minute video consultation that includes live review and discussion of documents you provide. Upload your documents when you book. The attorney will read them together with you during the call and explain what they mean for dividing the retirement benefit in your case.
A comprehensive consultation that includes review of your documents before the call, a video conference of up to 60 minutes, and calculations or legal research before or after the consultation. The $1,000 fee covers up to two hours of attorney time in total across all three phases — pre-consultation review, the consultation itself, and post-consultation work.
Additional time: If the work you request requires more than two hours of attorney time in total, additional time will be billed at $560 per hour. The attorney will pause and confirm with you before total time exceeds two hours, so there are no surprises.
Please review these terms before scheduling. Booking and payment constitute your agreement.
These terms govern paid consultations offered through Arizona's QDRO Practice, a service of ERISA Benefits Law, PLLC ("the Firm"). A consultation is a limited-scope legal service. It does not include drafting a domestic relations order, a qualified domestic relations order, or any other legal document; representing you in court or before any tribunal or agency; or ongoing legal representation of any kind.
Our limited-scope engagement will be neutral as to the parties in the case — we will not represent you or advise you adverse to the other party in your domestic relations case. Our neutral engagement will be for the limited purpose and duration of the consultation you have scheduled, and only after payment is received and confirmed. That relationship ends when the consultation concludes. No continuing attorney-client relationship is established by scheduling or completing a consultation, and you specifically agree that we will remain eligible to be engaged on a neutral basis to prepare a domestic relations order or a qualified domestic relations order in your case, on a neutral basis, if the parties agree to so engage us after this limited scope engagement is terminated.
The scope of your consultation is determined by the appointment type you selected when booking. Please read the description of your selected appointment type carefully.
This consultation is limited to a 15-minute video conference to answer the specific questions you submitted when booking. It does not include review of any documents, preparation work before the consultation, or any calculations, legal research, or follow-up work after the consultation.
This consultation is limited to a 30-minute video conference that includes live review and discussion of the documents you uploaded when booking. Documents will be reviewed during the consultation, not before it. It does not include review of documents before the meeting, calculations, legal research, or follow-up work after the consultation.
This consultation includes review of documents you uploaded before the consultation, a video conference of up to 60 minutes, and calculations or legal research before or after the consultation as discussed during the call. The $1,000 fee covers up to two (2) hours of attorney time in total across all three phases. If the work you request requires more than two hours of attorney time in total, additional time will be billed at $560 per hour. The attorney will pause and confirm with you before total time exceeds two hours. Any additional fees will be invoiced separately and are due upon receipt.
If the attorney determines after reviewing your booking materials that your matter does not require the level of service you selected, the consultation will be converted to a 15-minute Questions Only consultation ($150) or a 30-minute Consultation with Document Review ($300) and the difference will be refunded. You will be notified before the scheduled consultation time. Conversely, if during a consultation it becomes clear that additional services are needed, those services may be scheduled as a separate engagement — they are not included in the fee already paid.
The consultation fee is due in full at the time of booking. Your appointment is not confirmed until payment is received. Payment is processed through Square. All fees are quoted and charged in United States dollars. The consultation fee is an earned fee, not a deposit or retainer held in trust. It is not subject to IOLTA trust account requirements. If additional fees apply under Section 2 above, those fees will be invoiced separately.
For the consultation with Document Review, Calculations or Follow-up Work: if you cancel more than 24 hours before the scheduled time but the attorney has already begun pre-consultation document review, a partial refund may be issued at the attorney's discretion reflecting the time already spent. The attorney will notify you of any such reduction before processing the refund.
All refunds will be issued to the original payment method. Processing time is typically three to five business days depending on your card issuer.
The attorney will provide honest, practical guidance based on the information and documents available at the time of the consultation. No representation is made that the outcome of any proceeding, negotiation, or plan administrator determination will match any analysis provided during the consultation. Legal and factual circumstances vary, and the consultation is based solely on the information you provide.
Information you share in connection with this consultation will be treated as confidential consistent with the attorney's professional obligations under the Arizona Rules of Professional Conduct when engaged as a neutral between the parties to your case. Submission of documents or information through the booking platform or by any other means prior to the consultation does not, by itself, create an attorney-client relationship, but the attorney will treat that information as confidential, subject to disclosure to the other party in your case in connection with a subsequent proposed engagement to prepare a domestic relations order or qualified domestic relations order in your case.
Scheduling a consultation does not guarantee that the attorney can proceed. If a conflict of interest is identified before the consultation — for example, because the attorney has a prior relationship with your spouse or their attorney with respect to your case, and adverse to you — the consultation will be cancelled and your fee will be refunded in full. You will be notified as promptly as possible.
The Firm frequently represents both parties in a neutral capacity. If both parties to a divorce wish to use the Firm's services in connection with the same retirement account, they may each schedule separate consultations. By scheduling this appointment you agree in advance to the limited dual representation of both parties in a neutral capacity.
These terms are governed by the laws of the State of Arizona. Any dispute arising from this engagement shall be resolved in Pima County or Maricopa County, Arizona, at the attorney's election.
These terms may be updated from time to time. The version in effect at the time you complete your booking governs your consultation. Updated terms will be posted at this page.
